Terms of Use

These Terms of Use ("Terms") are an agreement between you and Homeglass ("Homeglass", "we", "us") and govern your use of the Homeglass app for iPhone and the website homeglass.app (together, the "Service"). By downloading, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old, and old enough to form a binding contract where you live (or have a parent or guardian's permission), to use the Service.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by Apple's Usage Rules in the App Store Terms of Service. You may not copy, modify, reverse engineer, resell or distribute the Service, or use it to build a competing product. All rights not expressly granted are reserved by Homeglass.

3. Your content and data

"Your Content" means what you type, the widgets you make, and the data you connect or add. You keep all your rights in Your Content. You give Homeglass a worldwide, royalty-free licence to host, process, transmit and display Your Content only as needed to provide and support the Service, including sending requests to AI providers as described in the Privacy Policy. You confirm that you have the rights to the content and data you use with the Service.

4. AI features

Widgets are built and changed by artificial intelligence models from what you describe. AI output can be inaccurate, incomplete or unexpected. You're responsible for checking that a widget shows what you expect before relying on it, and you must not rely on the Service for medical, financial, legal, safety or other important decisions. Requests may be processed, retained and used to improve models by third-party AI providers under their own terms, so don't include sensitive personal information in your requests. AI output is provided "as is", and you're responsible for how you use it.

5. Acceptable use

You agree not to use the Service to:

• break any law or violate anyone's rights, including privacy and intellectual property rights;
• create or display content that is unlawful, harassing, hateful, sexually explicit involving minors, or that promotes violence or self-harm;
• connect accounts, feeds or data links you aren't authorised to use;
• interfere with, overload, probe or attack the Service or the systems it connects to, including using data links to reach private networks or services that don't belong to you;
• get around plan limits, security measures or usage caps, or access the Service by automated means except through the app as designed;
• resell, sublicense or commercially exploit the Service.

We may limit, suspend or end access if we reasonably believe these rules have been broken.

6. Third-party services and data

The Service can show data from Apple frameworks, feeds, data links and third-party apps you connect (for example Gmail or Todoist). Those services are provided by others under their own terms; we don't control them and aren't responsible for their content, accuracy, availability or changes. Connections to third-party apps are read-only. A connection may stop working if the other service changes or withdraws access.

7. Homeglass Pro

• Homeglass Pro is offered as a monthly or yearly auto-renewing subscription, or as a one-time lifetime purchase. Prices and what Pro includes are shown in the app before you buy.
• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
• If a free trial is offered, it converts to a paid subscription when it ends unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you buy a subscription.
• You can manage and cancel subscriptions in your Apple Account settings, or in the app under Profile → Manage Subscription. Cancelling stops future renewals; you keep Pro until the end of the period you've paid for.
• Purchases are processed by Apple, and refunds are handled by Apple under its policies. Except where the law requires otherwise, payments are non-refundable by Homeglass.
• A lifetime purchase gives you Pro for as long as Homeglass offers the Service, on the Apple Account used to buy it. It isn't a guarantee that the Service or any feature will be offered forever.
• Pro is subject to fair use. Unusually heavy or automated use of the AI builder may be limited to keep the Service reliable and affordable for everyone.
• We may change prices or what's included in Pro. Price changes for subscriptions follow Apple's rules, including notice and consent where required.

8. Free plan and changes to the Service

The free plan has limits, such as how many widgets you keep at once and how many AI changes you can make each week; the app shows your current limits. We may add, change, limit or remove features, plans and limits at any time. iOS decides exactly when widgets refresh, so we can't guarantee real-time updates.

9. Ending your use

You can stop using the Service at any time and delete your account from Profile in the app. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the Service. Sections 3, 4, 10, 11, 12 and 14 survive termination.

10. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE, INCLUDING ALL AI OUTPUT AND THIRD-PARTY DATA, IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY DATA SHOWN IN A WIDGET WILL BE ACCURATE OR UP TO DATE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEGLASS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND US$50.

Some places don't allow certain warranties or liabilities to be excluded or limited. In those places, these limits apply only as far as the law allows, and nothing in these Terms limits rights you have under consumer protection law that can't be waived.

12. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless Homeglass from any claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Service, Your Content, or your breach of these Terms or of anyone's rights.

13. Apple

These Terms are between you and Homeglass, not Apple. Apple is not responsible for the Service or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app infringes a third party's intellectual property rights; Homeglass, not Apple, is responsible for investigating and resolving those claims. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms don't cover something, Apple's Standard Licensed Application End User License Agreement applies.

14. General

Changes to these Terms. We may update these Terms. We'll change the effective date above and, for significant changes, tell you in the app before they take effect. If you keep using the Service after that, you accept the updated Terms.

Governing law. These Terms are governed by the laws of the place where Homeglass is established, without regard to conflict-of-law rules, except where the law of the place you live requires otherwise. Nothing in these Terms takes away protections you have under the mandatory consumer laws of your country.

Other terms. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right isn't a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and Homeglass about the Service.
